Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Empiro website and platform (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
The Service is intended for real-estate professionals and businesses. You must be at least 18 years old and able to enter into a binding contract. If you use the Service on behalf of an agency or company, you confirm you are authorised to bind that organisation to these Terms.
2. Your account
- You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
- You are responsible for all activity that occurs under your account.
- Notify us promptly at contact@empiro.io if you suspect unauthorised use of your account.
3. Subscriptions, payments and refunds
Paid features of the Service are offered on a subscription basis. All subscription payments are processed by our third-party payment provider, Stripe. By subscribing, you also agree to the Stripe Services Agreement and authorise us and Stripe to charge your selected payment method.
- Billing. Subscriptions renew automatically for the chosen period (e.g. monthly or annually) until cancelled. We do not store your full card details — these are handled directly by Stripe.
- Cancellation. You may cancel at any time from your account settings or by contacting us. Cancellation stops future renewals; access continues until the end of the current paid period.
- Refunds. Any refunds are processed through Stripe back to your original payment method. Except where required by applicable consumer law, fees already paid for a completed billing period are non-refundable. To request a refund, contact us at contact@empiro.io.
- Taxes. Prices may exclude applicable taxes (e.g. VAT), which will be added where required.
Payments are processed securely by Stripe, a PCI-DSS Level 1 certified payment provider. Empiro never receives or stores your full card number.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of any applicable law (including data-protection, anti-money-laundering and real-estate regulations);
- upload content you do not have the right to share, or personal data you are not entitled to process;
- post false, misleading or fraudulent listings or requests;
- scrape, reverse-engineer, overload or attempt to gain unauthorised access to the Service;
- add, overlay, embed or burn in your own or any third party’s watermark, logo, branding, web address, contact details or other identifying or promotional marks onto any photograph, image or document you upload to or import through the Service;
- remove, crop out, obscure, blur, alter, tamper with or otherwise defeat the Empiro watermark or any branding, attribution or notice the Service applies to images or other content;
- include any personal, contact or identifying details — such as email addresses, web addresses or URLs, phone numbers, or company, agency or brand names — in the title, description or other content of a listing or request, as this undermines the anonymity the Service provides to all users;
- misuse other users’ contact details or off-market information shared with you.
We may suspend or terminate accounts that breach these Terms or that create risk or legal exposure for us or other users.
5. Your content and listings
You retain ownership of the listings, requests, messages and other content you submit. You grant Empiro a non-exclusive, worldwide licence to host, store, display and distribute that content as needed to operate the Service and to share it with the recipients you select. You are solely responsible for the content you publish and for ensuring it is lawful and accurate.
Automatic removal of personal details. To preserve the anonymity of all users, the Service may automatically detect and remove personal, contact or identifying details — such as email addresses, web addresses, phone numbers and company or agency names — from the content of listings and requests, both as you edit them and when content is extracted or imported on your behalf. You will be notified in the editor when such details are removed. You remain responsible for not submitting this information in the first place.
Watermarking of images. You acknowledge and agree that, to protect users and the integrity of off-market material, Empiro may apply a Empiro watermark to any photograph or image you upload to the Service, or that is extracted or imported from a web address or document you provide. This watermark may incorporate your anonymous user code so that the source of a leaked or redistributed image can be identified. You authorise Empiro to modify, resize, crop, re-encode and create the watermarked version of such images for this purpose, and you confirm that you hold all rights necessary to permit this. The watermark and any anonymous code it contains do not reveal your real identity to other users beyond what your privacy settings already allow.
6. Content standards and AI content moderation
You are solely responsible for all content you upload to or submit through the Service, including listing photographs, images, documents, descriptions and messages. By submitting content you represent and warrant that it is lawful, that you own it or have all rights and permissions necessary to submit it, and that it does not infringe any third party’s rights or violate any applicable law.
You must not upload, publish or transmit any content that:
- is unlawful, fraudulent, defamatory, obscene, sexually explicit, or that depicts or promotes violence, exploitation, abuse or illegal activity;
- contains personal data of third parties that you are not entitled to share, or that misrepresents a property, price or transaction;
- infringes the intellectual-property, privacy, publicity or other rights of any person; or
- contains malware, or content designed to deceive, harass or harm other users.
Automated and AI-based moderation. To protect users and maintain the integrity of the Service, Empiro may use automated tools, including artificial-intelligence systems, to review, screen and classify content you submit (for example, to detect images that may be unlawful or that may breach these content standards). Where such tools flag content as potentially inappropriate or non-compliant, we may, at our discretion and without prior notice: (a) hide or restrict the visibility of that content from public, shared or other users’ views; (b) remove or disable access to the content; and (c) where appropriate, notify you and ask you to take corrective action.
You acknowledge that automated moderation is provided on a best-efforts basis, is inherently imperfect, and may produce false positives or false negatives. A flag or removal is an operational safeguard and does not constitute a legal finding against you. We are not obliged to monitor or review content, and the use of moderation tools does not make us responsible for content submitted by users. If you believe content was flagged or removed in error, you may contact us at contact@empiro.io or reply to the moderation notice in your account, and we will review the matter. We may remove content and suspend or terminate accounts that repeatedly or seriously breach these content standards.
7. Real-estate disclaimer — no brokerage or advice
Empiro is a software platform that connects real-estate professionals. It is important that you understand the following:
- No brokerage or agency relationship. Empiro is not a real-estate broker, agent or intermediary, does not represent buyers or sellers, and is not a party to any transaction conducted between users.
- No investment, financial, legal or tax advice. Nothing on the Service constitutes investment, financial, legal or tax advice. You should obtain independent professional advice before acting.
- Listing accuracy. Listings, prices, valuations and request details are provided by users. We do not verify, endorse or guarantee the accuracy, completeness or availability of any listing or the legal status of any property.
- Off-market confidentiality. Off-market and confidential information shared through the Service must be treated as confidential and used only for the purpose for which it was shared. You must not redistribute it beyond the recipients authorised by the person who shared it.
- Your professional obligations. You remain solely responsible for complying with your own licensing, disclosure, KYC/AML and conduct obligations as a real-estate professional in your jurisdiction.
8. Intellectual property
The Service, its software, design and the Empiro name and logos are owned by us or our licensors and are protected by intellectual-property laws. The Empiro mark is a claimed trademark of the operator. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify or create derivative works of the Service except as permitted by law.
9. Third-party services
The Service relies on third-party providers (for example Stripe for payments, and our hosting, email and infrastructure providers). Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.
10. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features at any time. We may also update these Terms; for material changes we will take reasonable steps to notify you, and continued use after an update constitutes acceptance.
11. Disclaimers and limitation of liability
No responsibility for user content. Empiro is a neutral hosting and intermediary platform. The listings, properties, prices, search requests, offers and any other content offered, requested or exchanged through the Service originate solely from users. Empiro does not create, originate, endorse, verify, vet or control that content and is not a party to, and bears no responsibility or liability for, any property offered or requested, any communication, negotiation, agreement or transaction between users, or any act or omission of any user. This is separate from, and additional to, your obligation to ensure the accuracy of the information you submit: even where information is accurate, Empiro remains not responsible for the content itself or for the dealings that arise from it. Any reliance you place on content available through the Service is at your own risk.
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. To the extent permitted by law, Empiro shall not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data, goodwill or business opportunities, arising from your use of the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded, including your statutory consumer rights.
12. Indemnity
You agree to indemnify and hold Empiro harmless from claims, losses and expenses arising out of your content, your use of the Service, or your breach of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or where required to protect the Service or other users. On termination, the rights granted to you cease; provisions that by their nature should survive (e.g. intellectual property, disclaimers, liability) will survive.
14. Governing law
These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules, and the courts of Portugalshall have jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.
